Terms and Conditions
Please read these Terms and Conditions ("Terms") carefully before accessing or using the services provided by Carl Eden trading as Carl Eden Music Teacher and Musician and representing himself online as "The Eden Piano Academy" ("the Academy"). By accessing or using the Academy's website or subscribing to its services, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Academy's services.
1. General Terms
1.1. The Eden Piano Academy provides online piano lessons and resources through its website.
1.2. By subscribing to the Academy's services, you confirm that you are at least 18 years of age or have obtained parental or legal guardian consent to use the services.
1.3. The Academy reserves the right to modify or update these Terms at any time without prior notice. Continued use of the Academy's services after such modifications constitutes your agreement to be bound by the revised Terms.
2. Subscription
2.1. The Eden Piano Academy offers a subscription-based service. By subscribing, you gain access to the Academy's online piano lessons, tutorials, sheet music, and other educational resources.
2.2. The subscription fee and billing cycle will be clearly stated on the Academy's website. The Academy reserves the right to change the subscription fee or billing cycle at any time, but any changes will not affect the current subscription period and you are, of course, free to terminate your subscription before any new fees come into force.
2.3. The subscription fee is non-refundable, and no refunds or credits will be provided for partially used subscription periods.
2.4. You are responsible for maintaining the confidentiality of your account login information. You agree not to share your login credentials with others or allow unauthorized access to your account.
3. Intellectual Property
3.1. All intellectual property rights, including but not limited to copyrights, trademarks, and trade secrets, in the content provided by the Eden Piano Academy remain the sole property of the Academy.
3.2. By subscribing to the Academy's services, you are granted a limited, non-exclusive, non-transferable license to access and use the content solely for personal, non-commercial purposes. You may not reproduce, distribute, modify, transmit, display, or create derivative works of the content without prior written permission from the Academy.
4. User Conduct
4.1. You agree to use the Academy's services for lawful purposes only and in a manner consistent with these Terms.
4.2. You agree not to engage in any conduct that may infringe upon or violate the rights of others or the Academy, including but not limited to:
a) Uploading, transmitting, or distributing any content that is unlawful, defamatory, obscene, or infringing upon intellectual property rights.
b) Interfering with or disrupting the Academy's services or networks.
c) Attempting to gain unauthorized access to any portion of the Academy's website or systems.
4.3. You agree to use the site only for the purpose of learning to play the piano.
5. Limitation of Liability
5.1. The Eden Piano Academy strives to provide accurate and reliable content, but makes no warranties or guarantees regarding the accuracy, reliability, or completeness of the content or the suitability of the services for your particular purpose.
5.2. The Academy shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use or inability to use the Academy's services, even if advised of the possibility of such damages.
5.3. Video courses cater to the generic student however we all have different fingers, hands, etc. and may have conditions such as arthritis which may affect to what extent we can follow instructions. If you have a condition which may interfere with your ability to play the piano, or may be made worse by playing the piano, you agree to always consult a doctor and get medical approval before beginning Academy courses. The Academy shall not be held liable for the worsening of any medical condition due to following a video course.
5.4. All techniques taught in the Academy are attempted at your own risk and with a knowledge of your own medical conditions and limitations. If in doubt get specialist medical advice before attempting any technique. The Academy shall not be liable for injuries arising from any teaching or informal discussion, either recorded or live.
5.5. Different people progress at different rates. The Academy undertakes to provide all reasonable resources and support (as advertised) for you to make progress but cannot be held liable for the amount of progress you make.
6. Termination
6.1. The Eden Piano Academy reserves the right to suspend or terminate your access to its services at any time, with or without cause, and without prior notice.
6.2. Upon termination, your access to the Academy's content and services will cease, and you shall immediately cease using any materials obtained from the Academy.
6.3. You may terminate your membership at any time however your subscription will remain active for the remainder of the current subscription period and no refunds will be given.
7. Governing Law and Jurisdiction
7.1. These Terms shall be governed by and construed in accordance with the laws of England, without regard to its conflict of laws principles.
8. Severability
8.1. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.
9. Entire Agreement
9.1. These Terms constitute the entire agreement between you and the Eden Piano Academy regarding your use of the Academy's services, superseding any prior agreements or understandings, whether written or oral.
